Steps to building an Tax-Efficient Asset Protection Plan

"Own nothing, control everything!"   "If you do not own it, it cannot be taken from you!"  "There is nothing in the IRS Code that requires you to pay more than the minimum tax required by your returns.   So, you are entirely within the law to arrange your business and investment holdings in such a manner as to require the payment of the minimum amount of income and estate taxes."   These statements form the foundation of a tax-efficient asset protection plan.

How efficient your program will be in reducing your income and estate tax costs depends on (1) how well the plan is designed, (2) how well you follow the plan, (3) whether your plan is kept current with the tax law and the changing circumstances of your life, your business and your investments, and (4) whether you are willing to maintain the documentation required by IRS.

How well your asset protection plan protects your assets and income likewise depends on (1) how well the plan is designed, (2) how well you follow the plan, (3) whether the plan is kept current with the law, both federal and state and local law in the jurisdiction in which you live and in which the respective assets are held and entities operated, (4) whether you are willing to maintain the documentation required and the strength of your legal counsel when trouble comes your way.

Every asset protection and tax plan must be individually designed.   Just as there is no person exactly like you, no one's personal and business financial situation is the same as another persons.   Although there will be variations between plans based upon family make-up, family and financial goals, financial position at the time the plans are to be implemented, different areas of interest, varying types of investments and holdings, and tolerance to risk, there are certain basics that should be included in every well constructed plan.
